社区矫正方式的新发展——以上海市为例分析“电子镣铐”的推广可行性

On the New Development of Community Correction Modes: Analysis on the Feasibility to Popularize "Electronic Shackles" with Shanghai City as an Example

"电子镣铐"作为社区矫正中的新技术,使用时间较短且推广程度不高。上海市作为最早应用"电子镣铐"试点市之一,已经建立起较为完备的电子镣铐的使用制度。但是,作为新技术新手段,在应用的过程中必然存在着一些问题。首先,缺少立法来规范电子镣铐的使用;其次,财政的支持是决定电子镣铐应用的广度的必要因素;最后,人员的缺乏,包括技术人员和监管人员的不足,以及技术的缺陷,也是电子镣铐推行的障碍之一。为此,加快推进《社区矫正法》的颁布实施,有针对性地加大电子镣铐的财政支持,培养专业的监管人员和技术人员,是完善电子镣铐使用制度的不可或缺的要素。

As a new technology of community correction, ＂electronic shackles＂ have just been in use for a short period of time in few places. As a pilot city where ＂electronic shackles＂ were applied for the first time, Shanghai has established a rel- atively perfect system for the use of electronic shackles. How- ever, there will inevitably be some problems in the application of electronic shackles, as a new technology. The problems are as follows： lacking laws to regulate the use of electronic shack- les; lacking financial support which is a necessary factor for the popularization of electronic shackles; lacking the relevant work- ers, including technicians and supervisions; technical defects are also an important factor. To solve the problems, we should improve the system of using electronic shackles by accelerating the implementation of ＂Community Correction Law＂, pertinently enhancing financial support in the relevant work, and cultivating professional technicians and supervisors.
