刑法规范在适用中不可避免地会面临刑法文义的多重性、文义解释的瑕疵以及法律漏洞等现实问题,文义解释并不总能合理地解决疑难案件。刑法规范的具体应用是裁判者基于各种利益而进行的目的性建构,解释活动并非不折不扣地完全地按照罪刑法定原则进行严格解释。刑法解释是一种目的性的论证,裁判者对规范的理解是实质性的知识建构,以此来弥补刑法规范适用中的困境。在裁判者建构刑法规范的过程中,目的解释是实质判断常用的基本方法。

In the application of criminal law norms,it is inevitable to face the multiple nature of the criminal law concept,the defects of the interpretation of the text meaning and legal loopholes and other practical problems,the interpretation of the text meaning is not always reasonable to solve the difficult cases. The concrete application of the criminal law standard is based on the various interests of the judge,the purpose of the construction,the interpretation of the activities are not completely in accordance with the principle of a legally prescribed punishment for a strict interpretation. The interpretation of criminal law is a kind of objective demonstration,and the understanding of the norms is a substantive academic and professional construction,in order to make up for the plight of the application of criminal law norms. In the process of construction of the criminal law,the objective is the basic method of the substance interpretation.
