The Analysis on External-employed Police Force from the perspective of Administrative Law

摘要 警力外聘是法治社会、法治国家和法治政府建设征程中的非正常现象,属于严重的非依法行政范畴,属于依据契约扩充警力的非传统方式,源于中国治安状况恶化的现实原因和节省财政负担的经济原因。既不能契合全面推进依法治国的法治精神,又不能保持"四个全面"状态下的法治"正步",还不能主动发挥"四个意识"的积极作用。依法行政构成宏观前提,行政来源提供原因根据,行政主体确立资质要件,行政属性归类基本定位,行政执法解决发展趋势。 Police Force Employed Externally (PFEE) is an abnormal phenomenon in the construction course of society,country and government ruled by law, which is not law-based administration and is non-traditional pattern of police forceextension according to contract. It results from deterioration of security situation and economic policies to save financialburden in China. The phenomenon do not accord with promotion of ruled- by-law spirit, nor maintain positive process inthe “Four Comprehensive” state, nor play positive role of “Four Consciousness”. Administration according to law is themacro- premise. Administrative sources provides reasons. Qualification requirements of administrative subject should beestablished. Basic position should be classified by administrative attributes. Administrative enforcement solves developmenttrend.
