产业化视角下中药复方专利保护困境与突破路径探究

由于专利法舶来品特征与中药复方传统性特征之间的不协调性,专利法无法有效保护中药复方技术,严重影响中药复方技术的产能转化,阻碍了中药产业化发展。以促进中药产业化为目的,以现有专利相关法律法规和中药法律规范作为研究对象,在强调法律系统性和整体性前提下,首先分析中药复方技术特征以及我国有关专利保护法律法规的特征,其次研究中药复方技术保护相关法律规范之间的关系,提出构建以专利法为核心的中药复方技术多维法律保护体系的建议。

Due to the incongruity between the import features of the patent law and the characteristics of traditional Chinese medi- cine compound, patent law can not effectively protect the Chinese traditional medicine compound technology, seriously affect the transformation of traditional Chinese medicine compound technology capacity, hindered the industrialization development of tradition al Chinese medicine （TCM）. Article to promote the industrialization of traditional Chinese medicine （TCM） for the purpose, to rele- vant laws and regulations and traditional Chinese medicine with existing patent laws as the research object, first of all, analysis of the characteristics of the laws and regulations related to patent protection in our country, secondly the research of traditional Chinese medicine compound patent protection related laws, the relationship between the construction of patent law as the core of traditional Chinese medicine compound patent multidimensional legal protection system of the suggestion.
