应区别对待代孕协议中的监护权转移条款和其他条款,前者因违背法律的强制性规定而无效,后者要依据合同的一般生效要件而区分处理,如有偿代孕协议因违反社会公共利益原则而无效,而无偿的完全代孕并不当然无效。因此不能依据代孕协议确定代孕子女的法定父母,而应认定子宫提供者即受托人作为代孕子女法律上的母亲。委托人在符合《收养法》的前提下,经过受托人同意,可以收养代孕子女,与之建立父母子女关系。

It should be treated differently between the clause of custody and other clauses in the surrogate contract ,the former is invalid due to violation of the mandatory provisions of law ,the latter should be taken differently in accordance with the general requirements of the contract. For instance, business surrogacy agreement is invalid as a result of violating of the principles of public interest while the unpaid and entire surrogacy is not contrary to public morality and public emotion. It cannot decide the legal parents on the basis of legal surrogacy agreement. The uterine provider, trustee, is the mother of surrogate child in law. The delegators may adopt surrogate children and establish parentage if compliance to law.
