大学外部治理的法权逻辑与重构路径——基于“管办评分离”的政策视角

Legal Logic and Reconstruction of University External Governance——From a perspective of the policy of “separation of management-running-evaluation”

大学外部治理涉及政府、大学和社会机构三大权力(利)主体。"管办评分离"改革的实质是大学外部治理法权关系的重构,意味着传统单向度的政府管理分化为教育行政管理、大学自主办学、社会独立评价等多元主体的共治,其法权逻辑是法治化框架下三类主体之间法权关系的重新安排,其重构路径具体包括"放权""分权""赋权"和"融权"。

University external governance involves three major powers： government, universities and social institutions. The essence of the reform of ＂separation of management-running-evaluation＂ is to reconstruct law relationship of university external governance, Which means that the traditional one-way government management is divided into the multiple subjects such as the educational administration management, the University autonomous running school, the society independent evaluation and so on. The legal logic is to re-arrange the legal relationship between the three types of subject under the framework of the rule of law. And the path of reconstruction includes power of decentralization, decentralization, empowerment and right integration.
