摘要
随着城市更新速度的不断加快,因征收、拆迁、旧城改造等造成国有土地使用权到期或者提前收回的案例不断增多。本文以广州市为例,通过对现有国有土地使用权收回过程中存在的问题进行调研发现,目前国有土地使用权收回程序存在事前征询制度可操作性低、奖励制度刺激性不强、收回后缺乏结案手续、监管不到位等问题,针对现有国有土地使用权收回过程中存在的问题提出了对策建议。
with the rapid rate of urban renewal, the case of state-owned land use rights expire or early recovery is increasing which is caused by the levy, demolition, urban renewal and other reasons. Taking Guangzhou as an example, we found that: the current state-owned land use right recovery program exists to plant crops rush-build, pre-consultation system operability low, irritant reward system is not strong, the lack of closing formalities recovered, not the regulatory place and many other issues. Put forward suggestions for the existing state-owned land use right to recover during the problems. We put forward some suggestions for the problems in the process of stateowned land use right to recover.
