国防科技工业国防专利转让回许可研究

Defense Patents of Defense Technology Industry Transferred Back to License

随着国防科技工业国防专利数量的增加,国防专利转移转化成为人们关注的话题,国防专利转让回许可在一定程度上可以规避国防专利实施领域的限制以及保密制度的障碍,为国防专利转移转化提供可能。在分析国防专利转化特殊性和转让回许可基本框架的基础上,指出了国防专利转让回许可的优势,并从建立国防专利统一许可机构、健全国防专利价值评估和司法机构,以及完善相关法律制度3个方面提出了推进国防专利转让回许可的意见建议。

With the number increasing in national defense patents in national defense science and technology industry,national defense patent transfer and transformation has become a hot topic.To some extent,the transfer of national defense patent back to the license can avoid restrictions in such a field and provide possibility for the transfer and transformation of national defense patents.This paper,based on the analysis on the particularity of transfer of national defense patents and basic framework for transfer back to license,points out the advantages of transfer back to license for national defense patents,and proposes some suggestions on how to facilitate the transfer of national defense patent back to license in three aspects including setting a national defense patent licensing authority,perfecting evaluation and judiciary institutions,and completing relevant legal systems.
