摘要
图书馆微信服务过程中存在着著作权侵权风险,制约着图书馆自媒体移动阅读服务的发展。图书馆可以针对不同类型作品的著作权状况主动规避侵权;作出合理使用、法定许可、避风港原则的抗辩,以保障图书馆享有"适当的"著作权侵权责任的豁免权。图书馆还可以主张以默示许可模式,保障微信平台上作品的快速获取与传播、信息的广泛交流与互动,进而保证移动阅读服务实现。
In the process of library service, there is the risk of copyright infringement, which restricts the development of library mobile reading service. Libraries can take the initiative to avoid infringement according to the copyright status of different types of work and make fair use, statutory license, safe harbor principle of defense to ensure the library enjoy ＂appropriate＂ copyright infringement liability immunity. Library can also be advocated by the implied license mode, to protect the rapid acquisition and dissemination of works on the We Chat platform, the extensive communication and interaction of information, and thus ensure the realization of mobile reading services.
