摘要 在人口老龄化和市场经济发展的大背景下,退休返聘用工现象在我国普遍存在。我国退休返聘存在的问题,主要集中在劳动关系的认定、劳动基准的保护、社会保险的认定及劳动权利救济四个方面。通过借鉴域外退休返聘相关制度,结合我国社会主义市场经济的实际,提出一系列的解决方法。建议包括确立保障劳动者权利的指导思想、明确退休返聘的法律性质、扩大劳动法的调整规范、细化劳动者的划分类型、解除社会保险一体式捆绑形式、规范退休返聘程序、完善劳动权利救济体系等,试图在我国构建一个科学合理的退休返聘法律制度体系。 Under the background of aging population and the development of the market economy in China, there is now a prevailing trend of reemployment of the retired people. The main problems mainly consist in four aspects including the labor relationship confirmation, the protection of labor standard, and the confirmation of social insurance and labor rights relief documents. Through some references to relevant laws and regulations and with the combination of social market economy, we proposed that a series of solutions consisting of defining guidance thoughts of protecting workers' rights, specifying the nature of reemployment system for the retired, expanding the normalization of labor law, refining the types of workers, relieving all-inone binding of social insurance, normalizing the process of reemployment for the retired and perfecting the relief system for workers to construct a reasonable reemployment system of the retired.
