On Ethical Regulation of Administrative Discretion of Police at the Basic Level

警察行政自由裁量权是警察权的一部分,必须从多种路径规制其行使。在当前公安改革背景下,警察权的规范运行问题已被提上议程。长期以来,基层民警行政自由裁量权的行使中产生了许多问题,这些问题的产生与行政自由裁量权的属性,与基层公安工作的性质有着密不可分的关系,而从法律之外另辟蹊径,利用伦理规制手段研究警察行政自由裁量权的规范运行,必然有一定的现实意义。

The administrative discretion of police is a part of the police power,which must be regulated by many kinds of ways. In the context of the current public security reform,the standardized operation of police power has been put on the agenda. For a long time,administrative discretion exercise of grassroots police has produced many problems. These problems have a close relationship with the nature of the administrative discretion and the nature of the grassroots public security work. It is realistic to research the standardized operation of administrative discretion of grassroots police with ethical regulation methods by a way outside the law.
