不动产登记性质的解释论研究

摘要 从解释论的视角出发,结合《物权法》及其司法解释、《不动产登记暂行条例》及其实施细则等一系列不动产登记立法对于登记机构赔偿责任、审查模式等相关制度的规定,宜认为在我国不动产登记兼具民事行为与行政行为双重属性。登记机构与登记申请人之间的行政法律关系,强调登记行为的程序性和合法性,体现登记的行政行为属性;登记申请人之间的民事法律关系,强调登记产生的物权变动的效力,体现登记的民事行为属性。不动产登记于公私法领域的同时涉足决定了其救济程序的复合性。 From the perspective of the interpretation theory, with the enforcements of Property Law and other judicial interpretations, Provisional Regulations on Real Estate Registration and its enforcement regulations, the real estate registration should be considered in dual properties of both civil conduct and administration action according to legislations governing the liability for registration agency review mode, and other related systems. The administrative legal relationship between registration authorities and registration of the applicant emphasizes the legitimacy of the registration procedures and behavior, reflecting the administrative action property of registration; registration of civil legal relationship between applicants property of registra nature of its relief p emphasizes the effect of changes in property generated by registration, reflecting the civil conduct tion. In the field of public and private sectors, real estate registration is involved in the composite rocedure.
