摘要
作为市场经济条件下调整劳动关系的重要机制,集体谈判制度向来是产业关系研究的核心议题,然而丰富的西方集体谈判制度研究并不能对中国情境下的集体协商制度进行完全有效的解释。本文在对现有文献进行梳理与分析的基础上,提出国家、资本与劳工三股力量共同形塑着中国集体协商制度的发展方向。国家确定了集体协商制度的基本框架,而中国集体协商的制度空间能否被逐渐拓展需要考虑工会实践、工人抗争行动和资本力量角逐等多重因素。
As an importaat adjustment mechanism for labor relations under the condition of marketed economy, collective bargaining system has always been a core issues of indnstrial relations research. However, western collective bargaining research cannot be complete and effective explanation for Chinese collective consultation system. Based on the existing literature, this paper present that state, capital and labor forces shape the development direction of Chinese collective consultation system. The state determine the basic framework of collective negotiation. Whether the institutional space for Chinese collective bargaining can be gradually expand, there are multiple factors such as union practice, labor protest and capital power, need to be considered.
