摘要
就业中民族身份歧视是阻碍少数民族公平就业的重大障碍,这是多民族国家普遍面临的问题。就业中的民族身份歧视可分为制度性、个体性以及结构性就业歧视三种类型。在就业实践中,无法避免少数雇主的民族偏好和不均衡的社会经济结构所造成的民族就业歧视问题。民族就业歧视本身产生于竞争的人力资源市场,在当前条件下,仅仅依靠市场竞争机制与经济增长并不能充分保障各民族公平就业。在全面推进依法治国的大背景下,完善相关法治体系并有效施行可以为少数民族公平就业提供法治保障。
Ethnic identity discrimination in employment is an important obstacle to hinder the fair employment of ethnic minorities,which is a common problem in the world. Ethnic identity discrimination in employment can be divided into three types: institutional,individual and structural employment discrimination. In the employment practice,there is always the problem of national employment discrimination which is caused by the minority's national preferences and unbalanced social and economic structure. The discrimination itself is produced in the competition of the employment market,only rely on the market competition mechanism and economic growth and cannot fully protect the equal employment of all ethnic groups. In the context of the overall promotion of the rule of law,the improvement and effective implementation of the relevant legal system can provide legal guarantee for the National Fair employment.
