对“巧家县幼儿园钱仁风投毒案”的评析和反思

Reflection on the “Case of Qian Renfeng's Poisoning Children in a Kindergarten in Qiaojia”

云南省昭通市巧家县幼儿园钱仁风投毒案一案的侦查、审查及审判中,在尸体检验鉴定、物证的提取扣押辨认、犯罪嫌疑人的供述及辩解、死者死因的认定等方面均存在着问题;为此,需要从产生问题的原因、出现问题的责任、存在问题如何解决等角度进行了分析;并从本案中司法机关的办案人员责任心太差、疑罪从无的司法理念尚未在司法实践中真正得到体现、怎样树立正确的命案侦破理念等角度进行反思。

There are problemsin the investigation, checking,judgement, necroscopy, material evidence extra- tion, seizure identification and the suspect＇s statement, argumentationand thecause for the death. The case should be analyzed by its cause for the problems, the responsibilities for the case and the prospectives for the solution to the problems. The analysis of the case showed there was few responsibilities for the people who were responsible for the case an the principle in dubio pro reo was not successfully practiced.
