一妻多夫婚姻模式的现状、问题及解决对策探究——以四川省甘孜藏族自治州为例

Study on the Present Situation,Problems and Countermeasures of the Polyandrous Marriage Patterns——A Case Study of Ganzi Tibetan Autonomous Prefecture of Sichuan Province

"一妻多夫"的婚姻形态在四川省甘孜地区至今存在,无疑是违反我国现有法律规定的。从经济、主观以及民族宗教等当地民众选择这种婚姻模式的考量方面阐述其至今存在之缘由,并且分析了该婚姻模式日益显现出与社会的格格不入。探究在保障当事人合法权益的基础上,从立法、司法及政策方面谨慎推进一夫一妻婚姻全面实现之路径及对策。

This article expounds the polyandrous marriage form is still widespread in Ganzi Tibetan Autonomous Prefecture of Sichuan Province,which is in violation of the provisions of existing ＂marriage law＂. It points out why the polyandrous marriage can exist for such a long period of time—from the factors what the local people considered to choose this marriage patterns related to economic,subjective,and ethnic and religion and so on. With the continuous development of marriage form in society,the author of this article analyses the existence of this kind of marriage form and holds that it is increasingly showing its disadvantages in destroying the harmonious development of the society. On the basis of safeguarding the legitimate rights and interests of the parties,this article explores how to advocate the local nationalities gradually practice monogamy through legislative, judicial and policy approaches.
