私人文物捐赠法律问题探析

On the Legal Issues of Private Cultural Relics Donation

私人捐赠文物渐趋成为发达国家博物馆收藏的主流,进入新世纪后我国业界对此也开始加以密切关注。但时至今日,我国对涉及私人文物捐赠的相关法律问题还未开始深入研究,对文物捐赠协议也存在认知上的混乱,对文物来源审查程序也未能予以明确。鉴于上述问题,文章首先分析了与私人文物捐赠有较大关联的法律理论问题,然后对我国有关私人捐赠的法律规定进行了梳理,指出了其不足之处并对未来立法提出建议,以期对我国私人文物捐赠事业的发展起到积极作用。

Private cultural relics donation has become the mainstream of the museum collection in the developed countries.Since the beginning of the new century,China＇s industry has also begun to pay close attention to this.However,up to now we have not made in-depth research into the relevant legal problems concerning private cultural relics donation.There is also cognitive confusion on the agreement of cultural relics donation,and the process of examining the source of cultural relics has not be signified.As for the above problems,this paper first analyses the legal theoretical issues related to the donation of private cultural relics,sorts out the legal provisions on private donation in China,points out its deficiencies and puts forward suggestions for future legislation in order to play an active role in the development of private cultural relics donation in our country.
