The Evolution and Development of China's Criminal Labor Form

我国罪犯劳动形式主要历经奴隶社会、封建社会和社会主义社会这三个阶段的演变。这样的演变是由不同阶段的社会生产力水平所决定的,体现了各个时期为巩固统治的不同需求,体现了不同行刑理念,并使罪犯劳动功能得到不断发掘与实现。随着我国当前罪犯劳动形式存在的问题愈发突出,应借鉴中间监狱制,发展监外劳动,以及结合教育改造手段,发展公益型劳动,使罪犯劳动形式适应整个社会发展的要求。

China＇s criminal labor formshas mainly experienced three evolution stages of slave society, feudal society, and socialist society. The evolution of China＇s criminal labor is determined by the level of social productivity at different stage,reflects the different demands of the ruling class at various periods to consolidate his rule, embodies the different ideas of execution, and makes the criminal labor functions continuously being explored and implemented. As the problems existing in the current criminal forms of labor becomes more prominent, it is suggested that we should develop external labor with drawing lessons from the intermediate prison, and develop nonprofit labor, combining with the educational reform means, in order to make criminal labor forms adapt to the requirements of the whole society＇s development.
