摘要
索赔期可分为法定索赔期和约定索赔期,两者法律性质不同。法定索赔期体现国家意志,因而应定性为诉讼时效;而约定索赔期则体现当事人意思自治,应定性为约定免责条款。
The claim for compensation can be divided into the legal conformity and the conformity agreement,and they are different in legal nature.Legal conformity of the claim for compensation embodied the national will,and therefore should be a statute of limitations;And conventions conformity is the autonomy,the parties shall be agreed as exceptions.
