软法研究的勃兴在于国家与社会之于公共治理学说的理论共识以及公共治理现实的实践探索。作为国家治理场域的重要组成部分,城市社区治理与软法不仅在概念层面具有一定的逻辑关系,而且在现实层面发生了有效互动:软法的灵活易变性与城市社区治理的动态复杂性相协调、软法的整合功能与城市社区治理的多元合作特性相契合、软法的认同性约束与城市社区治理的互动协商相配合。这对于城市社区治理机制的建构提供了有益的启示,表现在健全规则供给机制、创新信息沟通机制、构建主体协同机制、建立协商对话机制、完善实施保障机制等方面。

The prosperity of the study on the soft law lies in the state and the society who have the theoretical consensus about the theory of the public governance and the practical exploration about the reality of the public governance.
