商事法治保障下的城市经济治理探析

On Urban Economic Governance by the Rule of Commercial Law

在经济深化改革及中国走向世界的背景下,现代化城市治理需要法治的保障,尤其需要商事法治的保障。商事法治定位于保护商人的商业判断及交易者的营利行为,能够提升城市经济治理能力和治理水平。建设现代型的商业制度宜居型城市,既需要在城市各治理主体间进行科学的权力配置,还需优化当前的商事纠纷解决机制,使法治真正成为城市经济治理中最为显著、最为核心的竞争优势。

Under the background of deepening reform and integration of China to the outside world, urban governance needs the guarantee of the rule of law, especially the rule of commercial law. Commercial law can promote the ability and level of urban economic governance by protecting the merchant＇s commercial judgement and the trader＇s profit-seeking behavior. In order to make a livable city by the rule of commercial law, we need not only scientific allocation of power between the governance bodies, but also optimizing the current commercial dispute resolution mechanism.
