历史上瑶族习惯法的突出特点是法典化程度高、管辖范围广、执行效度强,是以契约正义控制社区秩序的"准宪法"。瑶族习惯法是独具特性的判例法,是一种在有效实行"遵循先例"原则的同时,辅之以断罪有律,例则变通法则的以判例法为主、习惯成文法为辅的"混合法"。瑶族习惯法为研究少数民族习惯法提供了一个成型的、个案独特的判例法实例,为研究历史时期的中国判例法提供了一个独具一格的典型案例。

High codification, wide jurisdiction and strong execution are the outstanding characteristics of Yao customary law in history. Yao customary law is a ＂quasi--constitution＂ that keeps community orders based on contractual justice. It＇s a unique case law. While following the precedent effectively and giving priorities to case law, Yao customary law is supplemented by customary law, with a principle of judging by law and being flexible on cases. It provides an established, unique case law example for analyzing customary laws of ethnic minorities, as well as a typical, distinctive case for exploring Chinese historical case law.
