论高校突发事件应对中的法律适度介入

On the Law Appropriate Intervention in the Emergency Response of Universities

"法治"是我国依法治国发展的必然趋势,处于社会系统中的高校在处理事件时依法行事是法治的重要呈现,高校突发事件应对中的法律适度介入是依法治国和校园安全建设的重要保障、必然要求及关键所在。因此,在高校突发事件应对中结合高校的育人性、法律的强制性、高校与法律的特殊关系,发掘法律介入高校突发事件应对管理的困境,以期从理念认知、专业知识和具体践行"三位一体"路径实现高校突发事件应对中的法律适度介入,推动高校安全建设和平安发展。

The ＂ Rule of law＂ is the inevitable trend of the development of the rule of law in China. As a part of social system,it＇s very important for universities to deal with things according to the rule of law. In response to unexpected events in universities,moderate intervention of law is an important guarantee,an inevitable requirement and a key issue to reflect the rule of law and to keep the campus safe. Therefore,in response to unexpected events in universities,the education characteristic of higher institutions,the mandatory characteristic of law,the special relationship between university and law should be taken into consideration to explore the legal dilemma of university emergencies management intervention. The ＂ three in one＂ path of cognitive concept,professional knowledge and concrete practice should be adopted to induce appropriate intervention of law to solve the unexpected events in universities. Safety construction and security development could also be achieved in this way in universities.
