Research on the Green Intellectual Property Strategy Against Climate Change

为了应对全球气候变化,各国纷纷制定实施旨在减缓气候变化的绿色技术创新战略。对于绿色技术的创新与传播,知识产权法究竟是催化剂抑或阻却剂,目前发达国家与发展中国家依然各抒己见。本文试以现行知识产权法为基础,诠释绿色知识产权法的内涵与外延,探讨减缓气候变化的绿色知识产权法的主要应对策略。

In order to deal with the global climate change,various countries have developed so-called green technology innovation strategy to mitigate climate change. For the innovation and diffusion of green technologies,whether the intellectual property law is the catalyst or the retardant is still being debated between developed countries and developing countries. This paper attempts to explain the connotation and denotation of the green intellectual property law,and to discuss some relevant countermeasures of the green intellectual property law to mitigate climate change on the basis of existing intellectual property law.
