摘要
农村土地集约化经营是实现农村经济发展方式转变的重要内容,是实现农业现代化的必然要求,为新型城镇化奠定了坚实的基础。当前,我国法律制度和社会经济因素制约着农村土地集约化经营。实现农村土地集约化经营,必须要完善对农村土地经营规模的法律规制。要强化适度的农村土地经营规模的直接规制,一要建立适度的农村土地经营规模的标准制度,二要建立法定面积农村土地强制整理的制度。要加强农村土地经营规模的间接规制,一要放松经营主体的规制,二要放松流转方式的规制,三要加强社会保障制度建设。
The rural land intensive management is the important content and the inevitable requirement of the rural economy on recent trends, it also provides a solid foundation on the new-type urbanization in china. So far, the legal system and the social-economic factors restrict the intensive management of the rural land in our country. To realize the intensive management of rural land, it is necessary to regulate the scale of rural land management. To strengthen the direct regulation of the scale of rural management, the first is to establish a proper standard for the scale of rural land management; the second is to establish a statutory area of rural land compulsory consolidation system. To strengthen the indirect regulation of rural management scale, the first is to relax the regulation of the main business; the second is to relax the regulation of circulation; the third in strengthening the construction of social security system.
