The Comparative Analysis of Procedure Legislation of Local Major Administrative Decision

行政决策是行政的重要环节,直接决定后续事态的发展方向与结果。行政决策中的重大行政决策更是关乎国计民生,其影响力的广度与深度极大,故对重大行政决策程序的立法显得尤为重要。我国有关重大行政决策的程序立法总体呈现"地方优先于中央"的态势,同时各地方立法之间存在着共性与不足。地方重大行政决策程序立法的先行为中央统一立法提供了更多实践经验,中央立法的出台势在必行。在参考地方立法实践的基础上,中央还必须从全局入手,调和各方关系,这样才能实现立法的科学性和客观性。

The administrative decision-making is an important part of the administration, which directly determines the direction of development and the consequence. Among the administrative decisions, the major administrative decision has great influence on people＇s livelihood. So, the procedure legislation of the major administrative decision is important. This paper is based on a perspective of procedure legislation, and analyzes the documents from some places about the procedure legislation of the major administrative decision, trying to find the similarities and differences, providing the reference for the central government.
