专利制度是一种鼓励创新、促进创新成果传播和利用的法律制度。以专利法为核心的专利制度通过具体的法律制度设计来实现其制度宗旨。作为一种鼓励创新、进而促进经济社会发展的法律制度,专利制度也具有很强的经济理性,可以从经济学方面予以解构和认识。仅以专利授权为考察对象,尤其是其中的最优保护期限与最优保护宽度,亦能对专利法中的专利授权制度作出新的认识与理解,而这对于深刻认识专利法的制度精神也具有重要意义。

Just putting patent authorization as the object of studies, especially theoptimal protection period and ＆e optimal protection width thereof, we can also make a new understanding ofthe patent authorization system in the patent law, which has a profound significance to understand the system ofpatent law.
