A Study on the Effect of Patent License Filing

我国专利法实施细则中规定专利实施许可合同应当备案,但是对于专利许可合同备案的效力一直未予明确。通过对专利实施许可合同备案的法律属性进行分析,明确当前存在的主要问题,并对比国外主要国家的专利许可合同备案效力,提出我国专利许可合同备案效力的制度设计建议。

The Regulation for Implementing Patent Law stipulates that patent license agreements should perform filing procedure; however, the effect of the filing behavior is not clearly defi ned. By analyzing the legal nature of the patent license filing, sorting out the major existing problems, and comparing the effect of patent license filing in other countries, the paper presents a tentative system design for the effect of patent license filing in China.
