摘要
《美国数字千年版权法》第1201条禁止规避接触控制技术措施。司法实践中,联邦区巡回上诉法院要求规避行为与版权侵权之间存在关联,即关联规则;第九巡回上诉法院认为,单纯规避行为亦违反第1201条,明确拒绝适用关联规则。司法分歧是法院对保护技术措施的正当性认识不一致所造成的,两个法院的观点各自有其合理性。版权法应当保护版权利益,要求技术措施与版权保护的关联是必要的,但不能要求规避行为与版权侵权的关联;同时应当赋予被告一项抗辩:被规避的技术措施根本不是出于版权保护之目的。
Section 1201 of Digital Millennium Copyright Act(DMCA) banned circumvention of technical measures controlling access, but there is serious judicial confl icts. The Federal Circuit requires nexus between circumvention and copyright infringement; the 9th Circuit believes pure circumvention is banned under section 1201. The root of the confl ict is the different understanding on the legitimacy of the copyright law protection on technical measures. This paper believes copyright law has to protect copyright, and the nexus shall be required between technical measures and copyright; also the defendant can defend itself by prove the technical measure is totally not to protect copyright. To summarize, we shall not simply ban all circumvention; and we shall not require plaintiffs to prove defendant's circumvention is to infringe copyright.
