法学专家参与地方立法的思考

The Thought on the Law Experts in Participating in Local Legislation

法学专家参与地方立法,在我国各地得到了普遍实践并发挥了积极的作用。利用专家的法学专业知识和技能,不仅是《立法法》等相关法律法规的要求,而且对弥补立法机关自身力量不足的缺陷,提高立法的科学性、民主性和实效性有重要的意义。本文通过对法学专家参与地方立法的必要性、方式、实践中存在的问题等进行研究,试图对法学专家参与地方立法提出一些合理化建议,以促进科学立法、民主立法进程。

The participation of law experts in local legislation has been commonly put into practice in our country and has played a positive role in the process. The professional knowledge and skills not only meet the needs of the requests of the＂legislative law＂,but also cover the shortage of the insufficient strength of the legislature itself. It also plays an important role in improving the scientificity,democracy and effectiveness of the legislation. This article focuses on the necessities,methods and the problems existing in the practising of the law experts＇ paticipation in the local legislation. It tries to put forward some rationalization proposals to legal experts for improving the process of scientific and democratic legislation.
