在日本由经济大国转型为政治、军事强国的道路上,军事法起到了保驾护航的重要作用。为了确保军事法的有效运行,日本建立起多元立体的军事法制监督网络。国会、各级政府、最高法院以及社会公众等主体根据法律赋予的不同监督权力(利),对军事法的制定和实施进行各种监察、控制和督导活动,为实现对军事权合法运行的控制功能而形成一个相互联系、相互作用的有机整体。通过探究日本军事法制监督的体系构成,分析其权力架构及运行模式,对于促进我军整风反腐的深入推进和依法治军建设顺利进行,具有重要的启示和借鉴意义。

Military law plays an important role in Japan＇s transforming from economic giant to political and military power. To ensure the effectiveness of military law, Japanese government implemented military law supervision where Japanese parliament, governments at all levels, the superior court, and the public performed their duties by law to supervise, to control and guide the implementation of the military law and an interrelated and interactive system was established. By studying the military surveillance system, especially the relationship and the operation of military command andjurisdiction in Japanese military judicial structure, this paper introducesthe constructive practiceto deepen the ongoing anti-corruption movement in China＇s military construction.
