摘要
"四项准则"是源于语用学中"合作原则"的核心内容,在会话交际中遵守这些准则可以使目标信息更优质、有效地传达。法律语言也是语用学的研究范畴之一。文章以"四项准则"为理论依托,以刑法修正案(九)作为研究对象,试探讨法律语言修正活动中中立法者对"合作原则"的遵守行为,并将其定义为立法者的"合作性"属性,并进一步通过四项准则的具体内容对条文中信息量变更、照应词选择、条文间语言联系构建进行分析,充分阐释了"合作性"为立法、修法活动所提供的启示。
'The Maxims' are named as the core content of 'Cooperative Principle' theory in pragmatics, of which the observation are thought to bring forth the efficiency and quality in communication. This writing aims to discuss the application of 'the Maxims' in Amendment context, providing a new analytic prospective from pragmatics to analyze the lawmaker's 'cooperative' role in China's 9th Amendment to Criminal Law. The close study in the paper on information quantity, conjunctions and the use of cohesive devices in actual terms will serve as the just explanations of how the characteristic 'cooperative' sheds light on the legislation and revision.
