著作权交易保证保险制度的规范与完善有利于文化产业的发展。著作权交易保证保险制度基于法哲学基础、经济学基础和法律属性具备理论正当性。笔者从市场、政府和法律的多维视角分析了著作权交易保证保险市场机制、市场外部性以及著作权保证保险制度的现实困境与不足,提出了进一步规范市场交易机制、完善保证保险制度和加强政策导向等对策。
