On the Ownership of Agricultural Land Property Rights in China

我国农地产权制度改革滞后,影响了城镇化发展的质量,必须研究适应中国实际的农地产权制度。本文概括了现行农地集体产权的特征及其引发的负面效应,提出建立农地"二元"产权制度的设想,即将进城落户家庭自愿退出的土地界定为"国有农地",打破单一的农地集体所有的农村土地所有制格局。认为农地"二元"产权制度对消除"户籍人口迁移悖论"、提高农地规模化经营水平以及保护农民土地权益免遭侵害等都具有重要意义。

The reform of rural land property right system in China lags behind the quality of the development of urbanization, and it is necessary to study the system of agricultural land property right in China. The characteristics and the negative effects of the current land collective property rights are summarized. The idea of establishing a ＂dual system＂ property rights is put forward. It is of great significance to consider the ＂dual system＂ property right of agricultural land to eliminate the ＂paradox of household migration＂, to improve the level of agricultural land scale management and protect the rights and interests of farmers and so on.
