摘要
在违法性认识是否有存在必要问题上,应当采用自然犯和法定犯的区分说。违法性区分说存在其合理性,正确认识违法性认识的理论内核对于正确把握违法性认识意义重大。角色分工的特点决定着行为主体在故意实施某种犯罪行为时,一般具有充分的违法性认识。
Whether illegal cognition has the exiting necessity？We should adopt the natural crime and statutory crime Division-Theory. There is its rationality for the Division-Theory , a correct understanding of the kernel of illegality cognition theory has great significance which can enable us to correctly grasp the illegality cognition, characteristics of the role of the division of labor determines the line as the main body in the intent to commit a crime, generally has sufficient illegality understanding.
