论跨境电子商务/数字贸易的“eWTO”规制构建

On the Framework of the Agreement of Cross Board E-commerce/Digit Trade(“eWTO”)

WTO曾经拟启动电子商务规则谈判,但由于成员分歧而搁浅。但WTO相关协定包括GATT和GATS,都涉及或能推断出与电子商务有关的规则。ITA协定、正在谈判的Ti SA协定更是直接与电子商务有关。中国政府可发起推动WTO开展《电子商务诸边协定》即俗称的"e WTO"协定谈判。本文就"e WTO"构建的十大原则进行了建议性分析。

WTO has considered to negotiate an agreement on electronic commerce, but suspend since the deep different views among the major members. Even that, we find some articles from GATT or GATS may be applied to the cross board e-commence and/or digit trade. ITA and the Ti SA under negotiation are related to the cross board e-commerce and/or digit trade. China could promote the negotiation of the plurilateral agreement of e-commerce（so-called ＂e WTO＂）. This article elaborates the ten basic principles of this ＂eWTO＂ agreement.
