新中国的第一部《慈善法》,不仅其立法过程充分体现了科学民主立法的总方针,而且所构建的制度内容足以支撑其基本法的地位。众多的立法亮点彰显了我国对慈善事业的诸多新理念、新判断以及新思路,但由于受我国立法所处阶段等的限制,也存在不少法律制度构建方面的问题,这些问题同样突显当下我国立法所普遍存在的不足,需要从提高整体立法水平和质量的高度加以解决。

As the first Charity Law in China, not only the legislative process fully embodies the general principle of science and democracy, but also the system is enough to support the status of basic law. Plenty of legislative highlights reflect new concept, judgment and idea of China＇ s Charity, but due to the restrictions of legislation＇s stages in China, it still has man- y problems related to the construction of legal system, these questions show that the current legislation in our country has u- niversal inadequacies, it needs to be solved by improving the overall level and quality of the legislation.
