全面推进依法治国背景下绿色物流法治化研究

高速发展的绿色物流已成为各个国家经济增长的重要力量,同样也是我国实现可持续发展的重要增长点。完善的法律制度能为绿色物流业的发展提供坚实保障。然而,我国由于绿色物流行业起步晚、起点低,基础设施相对薄弱,绿色物流法律制度尚不完善,因此,有必要进一步构建绿色物流法律体系,完善相关部门的法律职能。当前,我国物流法律制度存在着法律位阶低、有的规定缺失、缺乏系统性、统一性、协调性等问题,应从构建绿色物流法律体系、完善政府监管职能、加大自律组织职能、强化消费者法律意识培育等方面采取措施,不断促进我国绿色物流法治化。绿色物流法治化不仅关系到我国全面推进依法治国的进程,而且是我国物流现代化的必然选择。

Abstract： The rapidly growing Green Logistics has become an important source of growth in every country. It also contributes to a sustainable development in China. A sound legal system provides a solid guarantee for the development of Green Logistics. However, since Green Logistics started late in China with a low starting point and the infrastructure is relatively weak, the legal system of Green Logistics is still to be built. Therefore, it is necessary to build the legal system and improve the legal functions of relevant departments. The current system has problems such as low legal hierarchy, missing provisions and so on. Measures should be taken to strengthen consumer awareness, build legal system for Green Logistics, improve the government＇s regulatory functions, and increase self-regulatory organizational functions. The legalization of Green Logistics not only impacts the process of approaching Rule of Law, but also is the inevitable choice of China^s logistics modernization.
