关于在行政审批改革背景下完善若干动物防疫行政许可事项的思考

Thinking on the Improvement of Several Administrative Licensing Items towards Animal Epidemic Prevention under the Background of Administrative Examination and Approval System Reform

本文分析了现行《动物防疫法》所涉及的动物饲养场所防疫条件审查、动物产地检疫和跨省引进乳用动物、种用动物及其精液、胚胎、种蛋的审批等三项行政许可,针对其中存在的问题进行了探讨,分别提出了取消饲养场所的动物防疫条件审查行政许可、设立动物防疫条件评估认证、重新界定申报动物产地检疫的范围、对动物产地检疫合格条件进行评估、推进种畜禽疫病净化、优化审批条件等建议,以期为下一步修订相关法律法规提供参考。

In this article, according to the Animal Epidemic Prevention Law of the People＇s Republic of China, three administrative licenses were analyzed, involving the investigation of animal health conditions in animal farms, animal inspection and quarantine at the place of origin, as well as the examination and approval of introducing dairy animals, breeding animals and their semen, embryos and hatching eggs from other provinces. With regard to these issues, the existing problems were discussed. For the purpose of providing reference for further revision of relevant laws and regulations, some suggestions were put for^vard, including canceling the administrative permission for the investigation of animal health conditions of animal farms, establishing the evaluation and certification system of animal epidemic conditions, redefining the range of animals subject to applying for producing area inspection and quarantine, assessing the qualified conditions for inspection and quarantine at the place of origin, and optimizing the system of examination and approval.
