刍议农村土地流转的立法变迁与发展

Legislative Changes and Development of Rural Land Circulation

农村土地流转是优化土地资源配置的有效方式,有利于实现适度规模经营。我国农村土地流转经历了从自发无序到规范引导、从进展缓慢到成效显著的过程,农村土地流转制度的立法规制经历了禁止流转、允许流转和规范流转三个阶段。但仍存在法律规范立法位阶低、法律规范体系性不强、法律规定不一致、法律规定内容矛盾、缺乏可操作性等问题。要加快构建农村土地流转立法体系,完善行政执法体制,健全司法保障体系,增强农民维权能力。

Rural land circulation is an effective way to optimize distribution of earth resources. It is conducive to the realization of the scale management of agriculture. In our country, rural land circulation went through the changes from spontaneous disorder to standardized encouragement, and from progressing slowly to achieving remarkable results. And the legislation of rural land circulation system went through the phases of prohibition, permission and standardization of circulation. However problems still exist, such as low hierarchy of the effectiveness of legal norms, weak legal norm system, inconsistent law regulations, conflictive law contents, and lack of manipulability of law regulations. We should speed up the construction of the legislative system of rural land circulation, perfect the administrative enforcement system, improve the judicial safeguard system, and strengthen farmers＇ ability to safeguard rights.
