从审判分离到审判合一——司法责任制在法院运行的调研

From Separation to Integration of Trial and Judgment:On the Court Operation of the Judicial Responsibility System

湖北司法改革法院试点实施方案中提出,司法责任制的改革目标是"严格遵循司法规律,科学划分审判组织的职权范围,落实审判责任制,形成权责明晰、权责统一、监督有序、配套齐全的审判权力运行机制,做到让审理者裁判,由裁判者负责,确保司法公正。"本文通过分析现状、借鉴经验、方法论证,提出了遵循司法规律、科学划分审判组织、引入多元化监督等观点。

The court pilot scheme of judicial system reform in Hubei puts forward the objectives of the reform as the following： ＂In order to form a complete set of judicial operating mechanism with clarified and united authority-responsibilities relationship under orderly supervision, the following should be done： to strictly follow the judicial law, to clearly define the remit of judicial organizations, to implement the judicial responsibility system so that the judge makes a ruling and simultaneously shoulders the responsibility to ensure justice＂. To ensure the implementation of judicial responsibility system, the author has put forward three ideas--scientific division of trial organization, following the juridical law and the introduction of multiple supervision channels。
