秩序与自由：立法中的张力平衡--从《云南省信访条例(修订草案)》谈起

在维护社会秩序与保障个人自由之间存在一定的张力,立法需要考虑其张力平衡问题。行政法规以及地方法规不宜对宪法上的权利进行限制;第二,当信访引发秩序维护与自由保障之间的矛盾时,需要以"中庸"原则平衡两者之间的矛盾,即公权力做出适当退让,在不失必要秩序的同时确保信访人行使信访权利。当然,信访人也应当做出必要退让,不应采用过激甚至违法方式行使权利,在温和行使权利的同时自觉维护必要的信访秩序。
