摘要
工会在参与在产业行动处理过程中,受到二重性职能的影响,其策略主要是在政治化处理和法制化处理两种模式之间选择。在这当中,党政的治理策略规定了工会的自主性发挥的空间范围,是工会策略的重要决定因素。但工会不只是被动地在由党政主导的治理结构中行动,工会的策略也受到其在劳动关系中的地位和影响,以及工会与工人群众关系工会与企业行政关系等多方面因素影响。随着劳动争议处理法制化进程的深化,工会的产业行动处理策略选择将有更大的自主性空间,工会可以在劳动争议处理中发挥更大的作用。
Owing to the dualist functions, the strategies of the Chinese trade union in dealing with the strikes are optional in between the political mode and the legitimate mode. The strike resolution of the Party-government is the imperative factor in shaping the degree of the trade union autonomy in devising the union strategies in strikes, It acts more autonomously in the legitimate mode, and the degree of the union autonomy is affected by a number of factors such as its status and influence in the labour relations structure, the relations between the union and the party-government/the enterprises/the workers, and so forth. Accompanying the legitimisation of labour dispute resolu-tion, the trade union is supposed to play a more significant role in the dispute resolu-tion.
