摘要
随着供给侧结构性改革的推进,我国劳动关系矛盾更加凸显,企业内部有效预防劳动争议显得尤为重要。本文系统总结了我国企业劳动争议预防机制存在的主要问题,在深入分析成因的基础上,提出了相应的对策与解决措施。只有通过政府、企业和劳动者的共同努力,建立合法用工、劳资协商、抱怨管理、劳动关系预警"四位一体"的系统性预防机制,持续推进其中每一项具体制度的建设和创新,才能真正实现劳动争议的源头治理。
With the supply-side structural reform, the situation of labor relation contradiction becomes more serious. It' s very important to resolve labor disputes within enterprises. This paper summaries the main problems of labor dispute prevention mechanism, analyzes the causes of problems and puts forward the corresponding countermeasures. Therefore, the government, enterprises and labors should make effort together to establish a four-in-one systematic mechanism which includes employment complied with law, bargaining mechanism, complaint management and labor relation warning system. Then, we can management labor disputes from the source.
