论知识产权法院体系的健全及其优化路径

The Perfection and Optimization on the System of Intellectual Property Court

我国已先后成立了北上广知识产权法院,但由于知识财产的特殊性,对于知识产权法院体系的完善还需科学化、合理化,构建中国特色的知识产权法院体系是实现知识产权强国战略的重要途径。文章通过探讨知识社会中法律的回应性特征,刻画了知识经济时代下知识产权法院体系建构模式的发展趋势,提出了知识产权法院体系建构所面临的新课题,如,知识产权司法保护的全球化、系统化,以司法为主导的知识产权保护日益彰显等。提出了优化方案,即,从体系的顶层设立上采用"三级二审"与"三合一"及集中管辖模式、设置技术审查官以及设计专利特别诉讼程序等方面来建构科学合理的知识产权专门法院体系。

China has established Intellectual Property Courts in Beijing, Shanghai and Canton. Howev- er, due to the special nature of intellectual property, the perfection of intellectual property court system needs to be scientific and reasonable, and the construction of intellectual property court system with Chi- nese characteristics is an important way to realize the strategy of strengthening intellectual property. In this paper, the article discusses the development of intellectual property court system in the era of knowl- edge economy by taking a deeper look at the response characteristics of the law in the knowledge society, taking the construction mode of the international intellectual property court into account, and puts forward a new topic that we are facing when we construct the intellectual property court system. For example, the globalization and systematization of IPR protection and the judicial--led IPR protection has become more and more. This paper puts forward an optimization scheme, from the top level of the system to establish a scientific and rational Court system of ＂three--level second--instance＂ and ＂three-in-one＂ and centralized management mode, set up technical review officer and design patent special procedures.
