高校法学教育职业化的现实困境与路径选择

法学乃实用之学。高等法学教育改革的实践过程中,一直面临法学教育应否职业化的定位争议。《关于完善国家统一法律职业资格制度的意见》将司法考试制度调整为统一法律职业资格考试制度。法律职业资格考试将具有准司法性质的法律从业人员纳入法律职业资格考试的范围。这一改变体现了国家对法律职业化教育的潜在要求。文章立足于法学教育为职业教育这一基点,通过对目前我国高等法学教育职业化过程中的问题梳理,试图构建更加合理规范的高等法学职业化教育模式。

Law is a practical science. In the practice of the reform of higher legal education, we have been faced with the positional controversy of whether the legal education should be professionalized. ＂Views on the improvement of national unified legal professional qualification system＂ adjusted the judicial examination system to the unified legal professional qualification examination system. Legal professional qualification examination brought the legal practitioners with the quasi-judicial nature into the scope of the legal professional qualification examination.This change reflects the state＇s potential requirements of the professionalized education of law. Based on the basic point that the legal education is a vocational education, this article combs the problems in the process of professionalization of higher legal education in China, and tries to build a more reasonable and standardized professional education model of higher law.
