Why Rule by Law Inevitably Calls for Legal Interpretation?

法律之所以需要解释,端在于人类创造的法律先天存在着诸多不足。人类理性自身的缺陷与追求无美不具的大全式法典之间的矛盾,使得人类要达致对社会生活的有效管理,就不得不对法律进行解释,以明晰法律的意义并弥补其不足;用以表述法律的日常语言存在的词不达意、一词多义和一义多词等问题导致法律的意义模糊,需要法律解释予以克服;语境转换导致的法律意义理解的多元化,亦需要通过解释辨明特定语境下法律的具体含义。法治需要法律解释,尤其需要法律方法指导之下的合理解释,这是我们必须牢记的法治训诫。

Legal interpretation is inevitable, considering the congenital deficiencies of law created by human beings. The contradictions between defects in human rationality and the pursuit for a perfect code make it necessary to take interpretations to clarify the meaning of the law and cover its shortage, in order to achieve effective management of social life. Legal interpretations are also used for dealing with vagueness of meaning in legal texts resulting from the defects such as polysemy, synonymy and words failing to express the meaning, so does to explicate the concrete legal significance under specific context when context conversion leads to multi-understanding. The rule of law requires legal interpretation, especially calling for reasonable interpretation in the guidance of legal methods,and this is the discipline of rule by law that we must keep in mind.
