司法改革背景下法院立案制度改革的反思——以土地补偿款分配纠纷诉讼为切入点

Reflection on the Reformation of Court's Filing System in the Context of Justice Reformation ——Starting from the litigation about revenue distribution of land expropriation compensation

司法改革背景下法院立案制度改革在不断推进,但改革的基本思路需要反思。以土地补偿款分配纠纷诉讼为例,法院通过策略性解读相关法律表达其不予受理的总体倾向。在规范、非规范因素以及内外部组织结构因素的制约下,我国法院民事初审立案实践分享了"立案政治学"的解释框架。微观入手的实证研究表明,基于规范分析的法院立案制度改革思路缺乏对立案难现状的切实把握,相关理论陷入"内卷化"困境。我国立案制度改革应回应司法实践中的创造性立案策略,回归化解纠纷这一根本目的。

The court＇s filing system is reformed constantly, but the fundamental theory of reformation should be reflected. In the litigation practice of revenue distribution of land expropriation compensation, the courts express their general tendency of denying by selecting the normative factors and situation factors, and internal/external factors. The court shared the explanatory framework of ＂filing politics＂ in the practice of filing. Through micro-empirical analysis we found that there are misunderstandings about the reform of filing system which based on specification law analysis. And the theory of filing system get into the volume change. Therefore, the reform of filing system should return to the resolution of disputes, which is the original purpose of judicial. And the filing reform should absorb the creativity filing strategies and dispute resolution modes from practice.
