摘要
在2004年中日韩与东盟"10+3"合作机制关于打击跨国犯罪第一次部长级会议上,东南亚地区的跨国有组织犯罪被归纳为八个类别,而恐怖主义犯罪被界定为八种犯罪形态。联合国安理会第1373号决议也"关切地注意到国际恐怖主义与跨国有组织犯罪之间所存在的密切联系"。目前在中国与东盟合作打击跨国有组织犯罪以及恐怖主义犯罪的过程中还存在着种种结构性阻碍。因此,在东盟框架内如何界定与惩治跨国有组织犯罪,并且实施有效的国际治理将影响未来东南亚整体的经济、社会、政治协调发展,以及中国在该地区的重要战略利益,区域内合作机制亟待完善。
In the first ministerial meeting of China, Japan and South Korea and ASEAN" 10 + 3"cooperation mechanism on com- bating transnational crimes in 2004, the transnational criminal organizations of Southeast Asia areas are grouped into eight catego- ries, and terrorism crime eight kinds of crime form. Also the United Nations Security Council resolution 1373rd"noted with concern that there is close Contact between the international terrorism and transnational organized crime". However, there are still a variety of structural obstacles in the cooperation between China and ASEAN in combating transnational organized crime and terrorist crimes at present. Therefore, how to define, punish transnational organized crime within the framework of ASEAN and implement effective international governance will affect the future Southeast Asia as a whole in its economic, social and political development, as well as China's important strategic interests in this region. Besides, it is urgent to improve the regional cooperation mechanism.
