道德权利:一个概念性考察

Moral Rights:A Conceptual Investigation

道德权利是全体社会成员作为一个人,基于人的生存与发展需要,根据社会公众普遍认同的道德理念、原则与规范所享有的社会权利。传统伦理学把义务作为主要研究对象,而否认权利的存在。"没有无义务的权利,也没有无权利的义务"的论断适用于一切权利义务关系,也包括道德权利与道德义务。确认道德权利范畴具有重要的现实意义:丰富与发展传统伦理学思想;契合"走向权利的时代";有利于树立正确的义利观,促进我国的道德建设。

Everyone in the society has his moral rights for the sake of survival and development. And as a human being, every people enjoy these rights which are based on the moral philosophy, principles and norms, which are generally accepted by the whole society. The obligation is taken as the main research object in the area of traditional ethics, but the existence of the right is usually denied. There are no obligations without the corresponding rights, just as there are no rights without the accompanying obligations in the world. The thesis applies to the relationship between all the rights and obligations, including the moral rights and moral obligations. It is of practical significance to confirm the category of the moral rights. That is, it can enrich and develop the traditional ethics thought, fit ＂to the right of the era＂ and establish a correct concept of justice and benefit for promoting the moral construction of our country.
